Kansas Harassment Laws & Penalties

In Kansas, harassment specifically applies to communications over the telephone.

Harassment occurs when the telephone is used for:

If you are charged with harassment over the telephone, you are facing Class A misdemeanor charges. This level of misdemeanor carries a potential sentence of 1 year in jail and fines of up to $2,500. If you allow another person to make harassing phone calls from your telephone you can also be charged with harassment over the telephone.

Kansas Stalking Laws & Penalties

As defined by Kansas statute, stalking is an intentional, malicious and repeated following or harassment of another person and putting them in fear for their safety. Stalking does not have to take place in person but can also be done over the phone, through the mail, emails, or other electronic means.

In most circumstances, stalking is a Level 10 person felony that carries up to 7 months in jail if you have no record. Any prior convictions elevate the potential sentence. If you have a prior history of stalking or harassment within the courts with the same alleged victim, your potential sentence jumps to a minimum 17 months in prison.

Until May of 2008, the defendant had to have made a “credible threat” to the alleged victim to be found guilty of stalking. This is no longer the case. Now if the stalking behavior buts the victim in reasonable fear of their safety, you can be charged and convicted of this serious felony.
